Wausau Worker's Compensation Attorney

We have the reputation and resources as a prominent workers compensation firm, and We fight for injured and disabled working people every day

The Best Workers Compensation lawyers in Wisconsin Focus Their Law Practice on Fighting Denied Work Comp Claims for Injured Workers Every Day.

If you are denied workers compensation benefits, Attorney John Jokela knows how to fight back to get you your settlement.   John is not a general practice lawyer.  For over 20 years, he only represents injured workers in Work Comp claims and Social Security Disability cases.  John knows how to fight workers compensation insurance carriers to get you your settlement as fast as possible.

A hard day’s work for a day’s pay. That is the deal we make with our employers. We all work hard for the income we need to take care of our family and to provide us the financial security to do the things we love to do in life. We each go to the job day after day and work hard for our employers. We don’t think about getting hurt on the job, but if it happens, we know our employer has workers compensation coverage to cover our medical bills and lost time so we can get back on the job as soon as possible. That is also part of the deal. So if a working person gets hurt at work and needs medical care and compensation for lost time, and the workers compensation carrier denies their claim, this is unfair and unjust. An unfair denial of a work comp claim can, and should, be made right.

An injured working man or women has the legal right to appeal an unfair denial by the insurance company. An injured working person also has another important right: the right to hire their own attorney—an attorney who will level the playing field and pursue an appeal. An unfair denial of a work comp claim should not be allowed to stand. An experienced and aggressive workers compensation lawyer like John R. Jokela can go immediately to work for you, file your appeal, and get you the settlement you are fairly entitled to. That way you can pay your bills, support your family, and get back to earning a living. If you are severely injured such that you cannot go back to work, Attorney Jokela can pursue benefits for permanent disability and lost future wages. There is no charge for an initial consultation, and you can talk to him directly to discuss the merits of your case.

Lost Wages While You Are Off Work and In Recovery from Your Injury

If you are injured on the job and miss time from work, you have the right to be compensated by the workers compensation insurance company for your lost wages during your recovery. The legal term for this benefit is “temporary total disability” and amounts to a weekly benefit equal to two-thirds of your average gross weekly wage.

Safety Violation

Workers compensation is a no-fault law, which means you are covered even if there wasn’t a negligence of safety or hazard involved in causing your injury. However, if there was a safety violation on the part of your employer that led to your injury, you may be entitled to increased compensation. Attorney John R. Jokela can discuss the details of your case and determine whether you are entitled to claim this additional compensation. He is not a general practice attorney, and instead only handles workers compensation and Social Security Disability denials for working people in Wisconsin.

“Works hard for clients rights! I hired him a second time because of his knowledge and success. He ensures that the client receives the maximum compensation.” – Jane

Unreasonable Refusal to Rehire

The Wisconsin Workers Compensation Law requires that employers take you back to work after your injury if you can still do your job. If an employer unreasonably refuses to take you back to work, then you can file a claim for up to one year’s lost wages against your employer. This claim can be made in addition to the other benefits you can claim for medical expenses, lost wages, and permanent disability.

Disfigurement

Sometimes an injury can cause a permanent disfigurement. Under Wisconsin Law, additional compensation can be claimed for disfigurement up to the equivalent of one full year’s lost wages. Disfigurement also can include a permanent limp caused by a work injury.

“John did a fine job in guiding me through the difficult process of workmens comp. He got me a fair settlement with the workers comp insurance company.” – Paul

If Your Work Comp Claim is Denied, I will have whatever size legal fight is necessary to get you the settlement you deserve so you can take care of your family

Permanent Disability

If you make a less than perfect recovery, your doctor will decide if you have a permanent disability due to your work related injury.  If you do have permanent disability, then the workers compensation carrier must pay this benefit to you on top of your lost wages.  If your claim is denied, Attorney John R. Jokela will find out from your doctor is there is a permanent disability and make a claim for this benefit as well as all other legitimate benefits you can claim.

Medical Expense and Mileage Expense

If you are injured on the job and medical treatment is necessary, the workers compensation carrier is required to pay the cost of ALL medical treatment at 100%. This includes any medications your doctor prescribes for your injury. You are not required to contribute any portion of the cost of medical care. You are also entitled to be reimbursed mileage costs in traveling to and from your doctor for treatment which our lawyer can help you with.

You Choose the Doctor who will Provide Your Care

In Wisconsin, you get to decide who will provide your medical care for your injury, not your employer or the workers comp insurance company. If you need surgery, you decide who your surgeon will be. You also have the right to a second opinion before surgery.

If Your Claim is Denied, You have the Right to File an Appeal, and You have the Right to an Attorney

Workers compensation law is complicated. There are many other benefits that can be claimed, and Attorney John R. Jokela will include all benefits that you are legally entitled to with your appeal.
